L., under the trade name of Finca Casa de la Virgen, hereinafter, PROVIDER, whose contact details also appear in the Legal Notice of this website.<\/p>\n<p>These Conditions will remain published on the website at the disposal of the USER to reproduce them and keep them as confirmation of the contract, and may be modified at any time by the PROVIDER. It is the responsibility of the USER to read them periodically, as those in force at the time of booking will be applicable.<\/p>\n<p>Contracts shall not be subject to any formality except as expressly provided for in the Civil and Commercial Codes and in this or other special laws.<\/p>\n<p>Acceptance of this document implies that the USER:<\/p>\n<ul>\n<li>You have read, understand and comprehend the above.<\/li>\n<li>A person with sufficient capacity to contract.<\/li>\n<li>It assumes all the obligations set forth herein.<\/li>\n<\/ul>\n<p>These conditions shall be valid for an indefinite period of time and shall be applicable to all contracts made through the PROVIDER&#8217;s website.<\/p>\n<p>The PROVIDER informs that the company is responsible for and knows the current legislation of the countries to which it offers its services and reserves the right to unilaterally modify the conditions, without this affecting the goods or promotions that were contracted prior to the modification.<\/p>\n<p><strong>Identity of the contracting parties<\/strong><\/p>\n<p>On the one hand, the PROVIDER of the accommodation reservation service contracted by the USER is Culandegan, S. L., with registered office at 46 Olof Palme Street. 9\u00ba. 35010 \u2013 Las Palmas de Gran Canaria, CIF B35827195 and customer service telephone number 630074613.<\/p>\n<p>And on the other hand, the USER, responsible for the veracity of the personal data provided to Finca Casa de la Virgen.<\/p>\n<p><strong>Object of the contract<\/strong><\/p>\n<p>The purpose of this contract is to regulate the contractual relationship between the PROVIDER and the USER at the time the USER accepts, during the online contracting process, the rental of rural houses.<\/p>\n<p>The contractual relationship of accommodation reservation involves the rental of the chosen house, for a limited time, in exchange for a determined price publicly displayed through the website.<\/p>\n<p><strong>Hiring procedure<\/strong><\/p>\n<p>The USER, in order to access the services or products offered by the PROVIDER, must be of legal age. Therefore, the USER must freely and voluntarily provide the personal data that will be required, which will be processed in accordance with the provisions of Regulation (EU) 2016\/679, of April 27 (GDPR), and the Law Organic 3\/2018, of December 5 (LOPDGDD), detailed in the Legal Notice and Privacy Policy of this website.<\/p>\n<p>It is reported that in accordance with the requirements of article 27 of Law 34\/2002, on Information Society Services and Electronic Commerce (LSSICE), the contracting procedure will follow the following steps:<\/p>\n<ol>\n<li>General clauses of<\/li>\n<li>hiring.<\/li>\n<li>Activation of reservations.<br \/>Right of withdrawal (cancellations).<\/li>\n<li>Claims and online dispute resolution.<\/li>\n<li>Force Majeure.<\/li>\n<li>Competence.<\/li>\n<li>Generalities of the offer.<\/li>\n<li>Price and validity period of the offer.<\/li>\n<li>Payment method, expenses and discounts.<\/li>\n<li>Purchasing process.<\/li>\n<li>Dissociation and suspension or termination of the contract.<\/li>\n<li>Guarantees and returns.<\/li>\n<li>Applicable law and jurisdiction.<\/li>\n<\/ol>\n<h5>1. GENERAL CONTRACTING CLAUSES<\/h5>\n<p>Unless specifically stipulated in writing, making a reservation with the PROVIDER will imply acceptance by the USER of these legal conditions. No stipulation made by the USER may differ from those of the PROVIDER if it has not been expressly accepted in advance and in writing by the PROVIDER.<\/p>\n<\/p>\n<h5>2. ACTIVATION OF RESERVATIONS AND PAYMENT<\/h5>\n<p>The PROVIDER will inform the USER in advance about the procedure that must be followed to make the accommodation reservation.<\/p>\n<p>The automatic system for calculating availability and prices allows the USER to choose the house they are interested in and immediately make the online payment of the rental price or, failing that, they can make a bank transfer within a maximum period of 48 hours.<\/p>\n<p>THE PROVIDER will not reserve the accommodation until it has verified that payment has been made. Once payment is verified, the PROVIDER will contact you by email to confirm the reservation. This term is understood as long as availability has been confirmed.<\/p>\n<h5> <\/h5>\n<h5>3. CANCELLATIONS (right of withdrawal)<\/h5>\n<p>The USER has the same rights and deadlines to proceed with the cancellation and\/or claim any possible defects or defects that the reservation presents, both online and offline.<\/p>\n<p>All cancellations must be communicated to the PROVIDER, indicating the corresponding invoice or reservation number. In the event of a refund of the amount, the USER could be penalized for the concepts indicated below:<\/p>\n<p>If the reservation is canceled within 48 hours following the reservation, the PROVIDER will return 100% of the USER&#8217;s reservation to the USER, as long as said reservation occurs before 14 days prior to arrival at the accommodation. <br \/>Si la reserva se anula antes de 7 d\u00edas de la fecha de llegada el PRESTADOR devolver\u00e1 al USUARIO el 50% de su reserva.<br \/>If the reservation is canceled within 7 days prior to arrival, as well as a no-show, the total amount of the reservation (100%) will not be refunded.<\/p>\n<h5> <\/h5>\n<h5>4. CLAIMS AND ONLINE DISPUTE RESOLUTION<\/h5>\n<p>Any claim that the USER considers appropriate will be attended to as soon as possible, and can be made through the contact form or through the contact telephone number that will be provided to the USER together with the reservation confirmation.<\/p>\n<p>If during the rental period there should be any breakdown in the installations or electrical appliances, the USER shall immediately notify the PROVIDER in order to solve these incidents as soon as possible.<\/p>\n<p>In case of force majeure (damage caused by water, fire, etc.), the PROVIDER will replace the reserved accommodation with another of the same characteristics. In case of unavailability of accommodations, the PROVIDER will reimburse the total amount paid.<\/p>\n<p>Online Dispute Resolution (Online Dispute Resolution)<\/p>\n<p>Pursuant to Art. 14.1 of Regulation (EU) 524\/2013, the European Commission provides a free access platform for online dispute resolution between the USER and Finca Casa de la Virgen, without recourse to the courts of law, through the intervention of a third party, called a Dispute Resolution Body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement, and may finally suggest and\/or impose a solution to the conflict.<br \/>Link to the ODR platform: <a href=\"http:\/\/ec.europa.eu\/consumers\/odr\/\" target=\"_blank\" rel=\"noopener\">http:\/\/ec.europa.eu\/consumers\/odr\/<\/a><\/p>\n<\/p>\n<h5>5. FORCE MAJEURE<\/h5>\n<p>The parties shall not be liable for any failure due to force majeure. The performance of the obligation shall be delayed until the cessation of the force majeure event.<\/p>\n<\/p>\n<p><strong>6. COMPETENCY<\/strong><\/p>\n<p>The USER may not assign, transfer or transfer the rights, responsibilities and obligations contracted.<\/p>\n<p>If any provision of these terms and conditions shall be deemed void or unenforceable, the validity, legality and enforceability of the remaining provisions shall not be affected in any way, nor shall they be modified in any way.<\/p>\n<p>The USER declares that he\/she has read, knows and accepts these General Conditions in their entirety.<\/p>\n<\/p>\n<h5>7. GENERAL INFORMATION ABOUT THE OFFER<\/h5>\n<p>The details of each reservation are informed to the USER in its respective description on the web page.<\/p>\n<p><strong>Inputs and outputs<\/strong><\/p>\n<ul>\n<li>Entrance: The key collection hours are from 17:00 to 20:00.<\/li>\n<li>Accommodation will not be available before 17:00.<\/li>\n<li>For arrivals after 20:00 and until 24:00, there will be an additional cost of 50,00 \u20ac.<\/li>\n<li>Arrivals later than 24:00 are not accepted; they will be left for 8:00 a.m. the following day.<\/li>\n<li>Upon arrival at the house and in accordance with current legislation, all occupants of the accommodation will be identified.<\/li>\n<li>The accommodation is delivered clean and with all kitchen utensils and kitchenware. Bath towels and sheets per person are included in the rental price.<\/li>\n<li>Departures: Departure time from the accommodations is until 12:00 noon. A person designated by the property will be at the accommodation at the agreed time to check the condition of the apartment and collect the keys.<\/li>\n<li>At the agreed time of departure, the tenants must be ready and have their bags packed and the apartment picked up and cleaned.<\/li>\n<\/ul>\n<p><strong>Extra services<\/strong><\/p>\n<p>If the USER is interested in hiring an extra service, he\/she must do so at the time of booking:<\/p>\n<ul>\n<li>Extra bed (El Pajar de Casa de la Virgen)<br \/>The extra bed rental is 15,00 \u20ac.<\/li>\n<li>Pets are not allowed to stay or visit.<\/li>\n<\/ul>\n<p><strong>Customer Responsibilities<\/strong><\/p>\n<ul>\n<li>In no case is it allowed to occupy the lodging for more people than those established in its maximum capacity.<\/li>\n<li>Electricity and water use must be rational.<\/li>\n<li>Children must always be accompanied by their parents and under their responsibility.<\/li>\n<li>The USER is responsible for the correct behavior of all his\/her fellow guests, otherwise, the PROVIDER reserves the right to expel the occupants of the accommodation, without the right to future claims or any type of compensation.<\/li>\n<li>Neither Finca Casa de la Virgen, nor the owner shall be liable for any direct or indirect damage that may be caused as a result of misuse of the accommodation, including without limitation: damage, loss after fire, theft, crime, accidents or other types of damage.<\/li>\n<\/ul>\n<h5>8. PRICE AND TERM OF VALIDITY OF THE OFFER<\/h5>\n<ul>\n<li>The prices indicated for each reservation include the Canary Islands General Indirect Tax (IGIC).<\/li>\n<li>The prices applicable to each property are those published on the website and are expressed in EURO currency. The USER assumes that the economic valuation of some of the services may vary in real time. Prices may change daily until the reservation is made.<\/li>\n<li>Any payment made to Finca Casa de la Virgen involves the issuance of an invoice under consent (art. 63.3 RD 1\/2007) in the name of the registered USER or the company name that the USER has informed at the time of placing the order. This invoice will be delivered to the USER at the end of the rental and the payment of the contracted services is made. If you wish to receive it by e-mail, you must request it by any of the means that the PROVIDER makes available to you, informing you that you may revoke such decision at any time.<\/li>\n<\/ul>\n<p>For any information about the reservation, the USER may contact the telephone number that will be provided after making the reservation.<\/p>\n<h5> <\/h5>\n<h5>9. FORMS OF PAYMENT, CHARGES AND DISCOUNTS<\/h5>\n<p>The PROVIDER is responsible for the economic transactions and makes possible the following ways to make the payment of an order: <\/p>\n<ul>\n<li>Bank transfer<\/li>\n<li>Credit card via payment gateway (Avaibook)<\/li>\n<\/ul>\n<p><strong>Safety measures<\/strong><\/p>\n<p>The website uses information security techniques generally accepted in the industry, such as SSL, secure page data entry, firewalls, access control procedures and cryptographic mechanisms, all in order to prevent unauthorized access to data. To achieve these purposes, the USER accepts that the PROVIDER obtains data for the purpose of the corresponding authentication of the access controls.<\/p>\n<h5> <\/h5>\n<h5>10. PURCHASING PROCESS<\/h5>\n<p>The website has a search system by different parameters to facilitate the choice of accommodation. Types of reservations:<\/p>\n<ul>\n<li>Reservation with immediate confirmation: Minimum price of the service stipulated on the website. You can make your reservation online and add the extra services that suit your needs.<\/li>\n<li>Price not available: In the event that the price of the service is not available, the USER will be informed as soon as possible by e-mail or telephone.<\/li>\n<li>Select the check-in and check-out dates, the number of people accommodated (adults and children) and the extra services chosen and add to the shopping cart. In this, only the selected services, quantity, price and total amount will be shown. Once the basket has been saved, taxes, charges and discounts will be calculated according to the data entered.<\/li>\n<li>The baskets do not have any administrative link, it is only a section where you can simulate a budget without any commitment on both sides.<\/li>\n<li>From the shopping cart you can place an order by following the steps below for its correct formalization:<\/li>\n<li>Verification of invoicing data.<\/li>\n<li>Verification of the reservation (dates, services&#8230;).<\/li>\n<li>Selection of the payment method.<\/li>\n<li>Place the order (buy).<\/li>\n<\/ul>\n<p>Within a maximum of 24 hours, on working days, an e-mail will be sent to the USER confirming the status of the reservation, as well as all relevant information.<\/p>\n<p>From the Online Reservation section, you can consult the description and characteristics of the accommodation, the services included, the optional services (extras) and the particular conditions of each property.<\/p>\n<h5> <\/h5>\n<h5>11. DISSOCIATION AND SUSPENSION OR TERMINATION OF THE CONTRACT<\/h5>\n<p>If any of these terms and conditions shall be deemed unlawful, void or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining conditions.<\/p>\n<p>The PROVIDER may, without prior notice, suspend or terminate the USER&#8217;s access to its services, in whole or in part, for any valid reason, including, without limitation, when the USER fails to comply with or follow any of the obligations set forth herein or any applicable provision of law, license, regulation, directive, code of practice or usage policies.<\/p>\n<p>When the PROVIDER exercises any of its rights or powers under this Clause, such exercise shall not prejudice or affect the exercise of any other right, power or remedy that may be available to the PROVIDER.<\/p>\n<h5> <\/h5>\n<h5>12. APPLICABLE LAW AND JURISDICTION<\/h5>\n<p>These conditions shall be governed by or construed in accordance with Spanish law in all matters not expressly set forth herein. Culandegan, S.
